Temporary Moratorium on Eviction Renters and Commercial Tenants Impact by COVID-19

The Marina City Council ratified a proclamation of a Local Emergency related to the COVID-19 pandemic on March 17, 2020.  This action was taken to ensure an effective response by the City to the COVID-19 pandemic.  In addition to ratifying the proclamation, the City Council also gave direction to the City Manager to take action as soon as possible on measures to protect renters and prevent eviction or rent increase of persons adversely affected by loss of work or income due to COVID-19.

On March 20, 2020, City Manager Long issued a temporary moratorium on eviction for nonpayment of rent by residential and commercial tenants impacted by the COVID-19 pandemic.  “In the interest of public health and safety, as affected by the emergency caused by the COVID-19 pandemic, it is important that we do everything possible to make sure our renters, homeowners and businesses are as safe and secure as possible during this COVID-19 pandemic”, said City Manager Layne Long.  Following State guidelines, the moratorium limits on a temporary basis any landlord’s ability to carry out evictions on any residential (including mobile homes and mobile home lots) or commercial property within the City of Marina for reasons related to COVID-19 impacts through May 31, 2020.   

The moratorium prevents evictions if eviction is due to:

  • nonpayment of rent or a foreclosure arising out of a substantial decrease in household or business income, including but not limited to, a substantial decrease in household income caused by layoffs or a reduction in the number of compensable hours of work, or a substantial decrease in business income caused by a reduction in opening hours or consumer demand, or substantial out-of-pocket medical expenses; and
  • the decrease in household income or business income or the out-of-pocket medical expenses as caused by the COVID-19 pandemic, or by any local, state, or federal government response to COVID-19, and is documented. 

The Order does not relieve the tenant of the obligation to pay rent, nor restrict a landlord’s ability to recover rent due.  For more information, click below.
