What are Dangerous Fireworks?
As a general rule, a firework classified as dangerous in the Health and Safety Code and that is illegal in California is on that either:
- Explodes
- Rises into the air
- Moves across the ground

Dangerous fireworks may also:
- Discharge flaming balls that can explode
- Contains poisonous chemicals
- Cause serious injuries
- Malfunction without warning
- Travel great distances and cause fires or property damage
Ramifications of Dangerous Fireworks
Under Section 12700 of the California Health and Safety Code, any person who violates any provision of the State Fireworks Law or regulations is guilty of a misdemeanor punishable by:
- A fine not less than $500 or more than $1000
- Imprisonment in the County jail for up to one year
- Both
If a person is in possession of illegal fireworks, all fireworks will be confiscated. A person possessing or using certain types of fireworks such as an M-80, M-100, or M-1000, or using fireworks to make explosive devices may be charged with a felony.
Any property owner that allows the willful possession, sale, or discharge of illegal or dangerous fireworks shall be held responsible and is subject to a citation resulting in a fine, imprisonment, or both.
